Terms of Service

These Terms of Service (“Terms”) govern your use of databooq, a form-building and data-collection service available at databooq.com and its subdomains (the “Service”), operated by an independent operator established in the Czech Republic. By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

databooq lets you build forms, surveys, quizzes and registrations, share them with respondents, and collect and analyze the submitted responses. Features include capacity-limited registrations, response exports, quizzes with scoring, shared workspaces and embedding forms on external sites.

2. Accounts

  • You must provide accurate information when registering and keep your credentials confidential.
  • You are responsible for all activity under your account.
  • You must be at least 15 years old (the Czech digital-consent age), or the higher digital-consent age applicable in your country, to create an account.
  • Notify us immediately at [email protected] if you suspect unauthorized use of your account.

3. Your content and respondent data

You retain all rights to the forms you create and the responses you collect (“Your Content”). You grant us the limited licence needed to host, process, transmit and display Your Content solely to operate the Service.

You are the data controller for respondent data you collect. When your forms collect personal data from respondents, you are responsible for having a lawful basis, informing respondents, and honoring their rights under applicable data-protection law (including the GDPR). databooq processes that data on your behalf as a processor under the Data Processing Addendum, which forms a binding part of these Terms, as further described in the Privacy Policy.

4. Acceptable use

You must not use the Service to:

  • collect data unlawfully, deceptively, or without a valid legal basis;
  • collect passwords or other login credentials, under any circumstances;
  • collect full payment-card numbers or card security codes, under any circumstances;
  • collect government identifiers (national ID, passport, social security numbers) unless legally permitted and clearly disclosed to respondents;
  • collect special-category data (health, beliefs, biometrics and similar) without a lawful basis under Art. 9 GDPR;
  • send spam, phish, impersonate any person or organization, or distribute malware;
  • publish content that is illegal, defamatory, or infringes third-party rights;
  • probe, overload, or disrupt the Service or circumvent its security, fair-use or capacity limits.

Forms are the main tool of credential-phishing scams, which is why the first three rules have no exceptions. We may immediately disable an individual form, and access to the responses it collected, or suspend an account that violates this section. If we restrict or remove your form or account, we will send you a statement of reasons: what was restricted, whether the ground was illegal content or a breach of these Terms, the facts that led to the decision, and how to contest it by replying to that notice (Art. 17, Regulation (EU) 2022/2065).

5. Reporting illegal content (DSA)

Forms on databooq are created by users, not by us. If you believe a form hosted on this Service contains illegal content, notify us at [email protected]. Every published form also carries a “Report” link. Include the form’s address (URL), an explanation of why you consider the content illegal, your name and email, and a statement that your notice is accurate and made in good faith.

We review notices promptly and may remove or disable the content, warn, suspend or terminate the account responsible, and will inform you of our decision. [email protected] is our designated contact point for member-state authorities, the European Commission and the European Board for Digital Services under Article 11 of Regulation (EU) 2022/2065, and for recipients of the Service under Article 12. Messages there reach a person, not an automated system; communication is accepted in English and Czech.

6. Availability and changes

The Service is currently in beta. We aim for high availability but the Service is provided “as is” and “as available”, without uptime guarantees, and features may change, be added or be removed as it matures. To keep the free Service available to everyone we may apply reasonable fair-use limits on storage, submissions and email volume; if your usage approaches them we will contact you before enforcing anything. If we discontinue the Service entirely, we will give you at least 30 days’ notice and the ability to export your data.

7. Fees

The Service is currently offered free of charge. If paid plans are introduced, pricing and payment terms will be published in advance and existing functionality you rely on will not be silently withdrawn from your account without notice.

8. Intellectual property

The Service, including its software, design and branding, remains our property. These Terms grant you no rights to our trademarks or source code beyond the use of the Service itself.

9. Liability

To the maximum extent permitted by law, we are not liable for indirect or consequential damages, loss of data caused by factors outside our reasonable control, or the content of forms created by users. Our total aggregate liability arising out of or related to the Service is limited to the greater of EUR 100 and the amounts you paid us in the 12 months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited by law (including liability for intent or gross negligence), and nothing limits the statutory rights you have as a consumer.

10. Termination

You may delete your account at any time from account settings. We may terminate or suspend accounts that breach these Terms. Upon termination your forms stop accepting responses; account data is deleted as described in the Privacy Policy.

11. Governing law and consumer disputes

These Terms are governed by the laws of the Czech Republic. Mandatory consumer-protection rules of your country of residence remain unaffected.

If you are a consumer and a dispute with us cannot be resolved directly, you can turn to the Czech Trade Inspection Authority (Česká obchodní inspekce, coi.gov.cz) for out-of-court dispute resolution.

12. Changes to these Terms

We may update these Terms. For material changes we will notify you by email or in-app at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
